User Agreement

Understanding your rights and responsibilities when using Maven Promo services

Agreement Overview

This User Agreement ("Agreement") establishes the terms between you and Maven Promo LLC ("Maven Promo," "we," "us," or "our") regarding your use of our website, services, and custom promotional product offerings.

By creating an account, placing an order, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by this Agreement and our Privacy Policy. This Agreement supplements, and should be read in conjunction with, our Terms & Conditions.

Account Registration and Use

You must be at least 18 years old to create an account and use our services.
You agree to provide accurate, current, and complete information during registration.
You are responsible for maintaining the security of your account credentials.
You may not transfer your account to another person without our written consent.
We reserve the right to suspend or terminate accounts that violate this agreement.
One person or entity may not maintain multiple accounts without authorization.

Acceptable Use

You will not use our services for any unlawful or prohibited purposes.
You will not submit artwork that infringes on intellectual property rights of others.
You will not harass, abuse, or harm other users or our staff.
You will not attempt to gain unauthorized access to our systems or networks.
You will not transmit viruses, malware, or any harmful code through our services.
You will not use our services to distribute spam or unsolicited communications.

Content and Artwork

You retain ownership of all content and artwork you submit to us.
By submitting content, you grant us a license to reproduce it for order fulfillment.
You warrant that your content does not violate any laws or third-party rights.
You are solely responsible for the legality and appropriateness of your designs.
We reserve the right to refuse to print content we deem inappropriate or offensive.
You agree to indemnify us against any claims arising from your submitted content.

Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy.
We collect and process your personal data as described in our Privacy Policy.
You consent to receive transactional emails related to your orders.
You can opt out of marketing communications at any time.
We implement reasonable security measures to protect your data.
We will notify you of any data breaches as required by law.

Order Modifications and Cancellations

You may request changes to your order before production begins.
We cannot guarantee that modification requests will be accommodated.
Once production starts, orders cannot be modified or cancelled.
Cancellation fees may apply depending on the stage of your order.
You are responsible for reviewing and approving all proofs before production.
Approved proofs constitute your authorization to proceed with production.

Termination Rights

Either party may terminate this agreement at any time with written notice.
We may terminate your account immediately for violations of this agreement.
Upon termination, you will lose access to your account and saved information.
Outstanding orders and payments remain valid after account termination.
Sections of this agreement that should survive termination will remain in effect.
You may request deletion of your personal data subject to legal requirements.

Amendments to This Agreement

We reserve the right to modify this User Agreement at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes your acceptance of the modified Agreement.

We will make reasonable efforts to notify you of material changes through email or prominent notice on our website. It is your responsibility to review this Agreement periodically.

Dispute Resolution

Any disputes arising from this Agreement will first be addressed through good-faith negotiation. If a resolution cannot be reached, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Arbitration will be conducted in English in the state where Maven Promo is registered
Each party will bear its own costs unless otherwise determined by the arbitrator
You waive your right to participate in class action lawsuits

Severability and Entire Agreement

If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.

This Agreement, together with our Privacy Policy and Terms & Conditions, constitutes the entire agreement between you and Maven Promo regarding the use of our services and supersedes all prior agreements and understandings.
